NHL Lockout 2012: Owners, Union Continue To Meet, But Only Discussing Secondary Issues

The good news is that for the first time since Sept. 12 -- three days before the NHL lockout became official -- the owners and the Players' Association have met. And when Sunday concludes, they will have done so for three straight days. The bad news is that the two sides have not discussed the component -- how to split hockey-related revenue -- that in essence has spurred the work stoppage.

Make no mistake about it: the sheer fact that the owners and players continue to meet is a great sign. However, until the core economic issues are hammered out, this lockout is still very much far from over.

Over the past two days, the sides have convened to discuss the secondary components that will still go to the creation of a new collective bargaining agreement. On Friday, topics such as medical care, drug testing, training camp and the schedule were touched on and meetings lasted for seven hours. On Saturday, the two sides went over the definitions of what comprises hockey-related revenue and that lasted about four hours. In theory, a mutual agreement of what its "definition" is should help the basis of the next proposal, whether that's by the owners or players. One would think that when the grey areas are cleared up, the next CBA offer should be a little more "acceptable."

Of course, when the next proposal will be made remains the big question. Time is ticking down to where the new CBA has to be agreed upon or regular season games will start to be crossed off. Some have said that a new deal will have to be reached by the middle of the coming week as the season starts Oct. 11 and it will take time for the players, coaches and other personnel to get ready. It's not like a deal gets done Sunday, teams will begin training camps the next day, especially with many players already overseas or still at home, away from their team's city.

Sunday, the agenda likely will include health and safety issues and other legal topics, according to the Sporting News. More talk on the definition of hockey-related revenue could also be revisited because a mutual agreement was not found just yet.

Even though commissioner Gary Bettman and NHLPA head Donald Fehr did not attend these meetings with the group, they had their own, private talks.

"I spent a few minutes with Gary talking about the overall situation, and we agreed to keep in touch," Fehr said Saturday, as reported by the Sporting News. "I am sure we will talk again (Sunday). I don't know whether will meet again (Sunday). That remains to be seen.

"I am not going to talk about the specifics, but in general we're trying to discuss how do we find a way to make an agreement. How do we bridge the gap on the major issues that are between us."

NHL deputy commissioner Bill Daly on Friday said that the owners needed to hear from the players that they would compromise on the hockey-related revenue split in order to for the "meaningful issues" to be discussed. As such, Daly even acknowledged Saturday that topics talked about this weekend have been considered the " underbrush." That means nothing is likely to get done without the players budging. If the general feelings of players that the union is stronger than ever is correct, we could still be in for a long work stoppage and even a lost season. The silver lining remains that the two sides will be meeting for the third straight day Sunday and nothing can ever get done without that happening.

(AP) ? Authorities still haven't released the identity of a man who fatally shot himself in the head on live national television at the end of a high-speed carjacking chase that began in Phoenix and ended close to the California border.

Fox News was covering the chase that began about midday Friday using a live helicopter shot from Phoenix affiliate KSAZ-TV. The man driving a copper-colored four-door sedan stopped, ran into the desert and placed a handgun to his head and fired.

The man was declared dead at the scene, according to Sgt. Tommy Thompson, a Phoenix police spokesman.

Fox News anchor Shepard Smith told viewers that the video was supposed to be on a 10-second delay so it could be cut off from airing if something went awry.

"We really messed up, and we're all very sorry," Smith said.

Fox apologized for showing the violence on air.

"We took every precaution to avoid any such live incident by putting the helicopter pictures on a five second delay," said Michael Clemente, executive vice president of news editorial. "Unfortunately, this mistake was the result of a severe human error and we apologize for what viewers ultimately saw on the screen."

More frequently than its rivals, Fox News Channel picks up car chases from its local affiliates and airs them live. It's gripping television, a live mystery with no clear resolution, and often provides a short-term ratings boost as viewers tune in to see how it ends. Critics say the chases themselves rarely rise to the level of national news. The Phoenix station was not airing the chase live when it ended.

Thompson said the man allegedly stole a car from a couple at gunpoint outside a Phoenix restaurant just before 11 a.m. MST.

Police officers located the vehicle and began a pursuit and the man fired several shots, Thompson said. He said at least one shot hit the police vehicle but the officers escaped injury.

The suspect headed west on Interstate 10, then pulled onto a dirt road near the town of Tonopah that Thompson said was "70 to 80 miles east of the California line."

TV footage showed the man exiting the vehicle and running erratically in a field before putting the gun to his head and firing. He then fell to the ground.

"Efforts to revive him were not successful and he was dead at the scene," Thompson said. "We don't have an ID yet."

Fox returned repeatedly to shots showing the car passing big-rig trucks that typically travel at about 70 mph as if they were standing still.

Police cars did not appear to be immediately behind the car during most of the chase.

Smith was narrating the video and clearly had his doubts about what was being shown from the moment the man stopped the car. "This scares me," he said.

"You wait for the end of these things and you worry about how they may end up," he said. "This makes me a little nervous, I got to tell you. A little nervous."

After the man shot himself, Fox's picture quickly cut to Smith, who was shouting "get off, get off, get off, get off."

Smith apologized repeatedly following the commercial break.

"That didn't belong on TV. We took every precaution we knew how to take to keep that from being on TV and I personally apologize to you that that happened," he said.

Noble Energy contracts Atwood?s drillship for exploration program

Noble Energy, US based oil and gas exploration and production company, has announced signing a three year contract with Atwood Oceanics? subsidiary for the under construction offshore drillship named Atwood Advantage.

The company will use the Atwood Advantage to carry out its deep water exploration and development program.

Upon completion of the drillship, Noble Energy will pay $584,000 per day as the lease rate for the offshore drilling equipment.
Noble Energy will first employ the drilling rig to spud deep oil targets in the Eastern Mediterranean.

The 12,000ft water depth and 40,000ft drill depth ratings, dual BOP stacks, increased mobility, and improved offline capabilities will further complement the company's offshore program.

Daewoo Shipbuilding & Marine Engineering Co., Korean shipbuilder, is building the rig and is expected to deliver it in the final quarter of 2013.

Google, Microsoft, Apple, Facebook: Please, Will The Regulators Stop Worrying About Monopolies?

One of my favourite economists, Lynne Kiesling, has written on why the regulators and bureaucracies really should worry a great deal less about the possibility of monopolies in the tech space. A basic point is that the whole field is simply changing too quickly. She also links to this well argued piece on the fleeting nature of the monopolies that are being worried about.

No one actually gets a monopoly for long enough to be able to fleece consumers through having that monopoly. This is as true of Facebook as it is of Google, Microsoft or Apple.

I would go further on two points. The first is that given the speed with which these markets move bureaucracy and the law just isn?t the correct method of dealing with the problem even if it does exist. It is almost impossible to imagine any governmental organisation spotting a problem, working out what to do about it and then crafting the solution in a period under two or three years. Do recall that this is about the period of time since the release of the iPad itself. Quite: if the iPad had been noted as a monopolistic product right on the day of first issue we?d be expecting a bureaucracy to be just about ready to do something about it today. Which does suggest that bureaucracy isn?t the way to deal with any problems we might have in this sort of technological space.

The second point is slightly more theoretical. The current government and legal attitude towards monopoly is that if you?ve got great market power then you might indeed be a monopoly and thus you?re subject to special rules. Investigations, constraints on how you can leverage that market power and so on come into play. The argument being that if you?ve this market power you might deploy it to the detriment of the consumer.

There?s a slight problem with this though: economists have gone one stage further in considering monopolies. It?s not a wholly agreed point but there?s a decent level of consensus. Having market power, even having a monopoly, isn?t sufficient to induce firms to act against consumer interests. Having uncontestable market power, an uncontestable monopoly, might well be: but the crucial point is whether they are contestable or not. Possessors of contestable market power or monopoly can be assumed to either not act against consumer interest or to be about to lose said market power or monopoly.

Think of it this way. Assume that one company, just for the sake of argument we?ll call it Apple, had all the patents necessary to stop anyone else making a smartphone of any kind at all. They launch the iPhone and no one is allowed to produce anything even remotely similar: there?s no Android, Windows Phone, Firefox cannot even play with their OS and so on. We would indeed be worried about Apple creaming monopoly profits off the top of that market for the next decade or so that those patents are valid. We might indeed want to curtail what they can do.

Now consider our actual world: yes, there are still patent fights. But they are about minor details of the implementation of how you build and operate a smartphone (well, OK, rectangles with rounded corners aside) not about the very concept of one at all. There are a number of operating systems for smartphones, there is a larger number of manufacturers of them. We do see Apple with great market power (which is why they?re making the vast majority of the profits in the sector) but it is obviously true that Apple?s position is contestable. Given this contestability Apple cannot simply rest on its laurels and bleed the consumers dry. It must continue to develop the iPhone, improve the consumer experience or it will lose that predominant position. If they stumble for a year or two Microsoft and Nokia, or maybe Google and Samsung, or some as yet unknown competitor, will come and eat their lunch.

So we don?t really need to worry about Apple?s market position because the contestability of it, the precariousness of it, means that they cannot act like a monopoly and hope to hold on to that position. And it is not market power, nor even monopoly, that we are actually worried about but the misuse of it.

The same logic applies to Microsoft and browsers. To Facebook and social networking. Amazon and e-books and yes, even to Google and search engine placement. Anyone who tries to abuse a dominant market position is very quickly going to lose that position. Simply because all of these monopolies are contestable. There are enough other firms vying for the space (and it?s never been easier to raise the VC money to attack such spaces if you want to create a new rival) that even those who have achieved market dominance cannot exploit it. And given that it?s the exploitation, not the market dominance, which is the potential problem there isn?t in fact much of a problem.

There are economists who would say that a true monopoly without government action to support it is impossible. I wouldn?t go as far as that hardline position. I think there can indeed be monopolies for other reasons like network effects, to say nothing of patent rules. But I do think that some of the current worries about monopolies in the tech space are overdone. Purely and simply because they?re contestable monopolies and thus not really exploitable in the sense that we worry about when considering the very idea of monopoly.

That said, despite our positive hands-on time with the Wikipad (even in its prototype state), $500 is a heck of a lot of money to plunk down on an unproven device from an unproven company. The argument gets harder when you remember Sony's PlayStation Vita -- an arguably much nicer device with a far larger library of gaming content that costs half the Wikipad's price at $249.99. Bower doesn't see the logic in this argument. "It's double the price, but it's also double the size," he pointed out. "If you buy a tablet that's seven inches, you can get a $199 tablet -- it's called a Google Nexus or a Kindle Fire. If you're gonna get a full 10-inch tablet, a tablet to this quality, you're gonna spend $499 to $749 ... if we were talking about a 7-inch device or a 5-inch device, and we were at this price point, then it'd be a different story." Admittedly, the tablet -- as a standalone device -- isn't too shabby. But will it woo consumers away from the likes of Apple and Samsung? Bower hopes as much, but we're not so sure.

Pilot proposes with plane crash prank

(ABC)One man's airborne proposal took his girlfriend's breath away when he pretended that their small plane was in trouble and asked her to read an emergency checklist that contained instructions for a "ring engagement procedure."

The groom-to-be was filming the entire episode on hidden camera, and he posted the video, "In Descent Proposal," on YouTube.

The man, Ryan Thompson, was flying his girlfriend, Carlie Kennedy, on a breathtaking flight above the Chicago skyline.

The video, which includes the date 2.11.12, contains no dialogue, just music and captions at the bottom of the screen to describe the conversation.

At first, the two are smiling. They appear happy, and the sky forms a brilliant blue backdrop.

"I thought he was surprising me for Valentine's Day," said Kennedy. "It was a gorgeous day, as you can see in the video."

But after a short while, the plane appears to shake and Carlie's smile falters.

"All of a sudden I felt my stomach kind of go up in my throat and I realized we were heading straight for the water," Kennedy said. "And then he [Thompson] said, 'Honey, I need you to stay calm. The flight controls aren't working.'"

In the video, Kennedy appears clearly shaken, but she complies, reading the emergency checklist he hands her.

"Unresponsive flight controls ? ," she begins, eventually getting to the instructions "to initiate the ring engagement procedure."

"Pilot in command. Determine if he is a good mate. Note: he will always love and honor you," she continues, appearing not to fully comprehend the meaning of the words .

"I genuinely did believe that we were going to die," she said, recounting the moment. "I felt like our lives depended on me making it through that checklist."

While Carlie reads, Thompson reaches into his pocket for the ring.

When she reads the question "Will you marry me?" she stops for a moment, stunned, then covers her face and bursts out laughing, casting several glances at the ring he's holding in front of her.

"Will you marry me?" he asks.

She said yes.

"A lot of the women that I've told the story [to] said, 'I would have slapped him,'" Kennedy said.

"But, for us, it was a perfect match," said her now-fiance, Thompson.

Many practitioners will agree that the IRS is generally lenient in allowing the abatement of penalties for reasonable cause.  Reliance on a tax expert or IRS advice, irregularities in mail delivery, and death or serious illness are commonly deemed to be reasonable cause for a failure to file or pay taxes on time. Frequent Enrolled Agent jobs involve helping taxpayers obtain IRS penalty relief due to reasonable cause.  As Giovanni Rossman found out, however, a series of extension requests may vitiate reasonable cause even when there is emotional distress, financial difficulty, and misinformation provided by
a tax advisor. Giovanni’s mother died in August of 2005, and Giovanni was named executor of the estate. Prior to the due date of the estate tax return, an extension request was filed and granted, making the estate taxes due and payable on November 15, 2006. When the return was filed, Giovanni requested a second extension to pay the tax liability of over $800,000 so that she could secure loans with real estate and liquidate assets sufficient to pay the tax. An extension was granted until February 15, 2007. On February 14, 2007, she sought and was granted yet another extension to August 15, 2007. At no time did she make a request of the IRS for an installment payment agreement or seek advice about payment options, which are known by any tax professionals with EA training. By the last deadline, Giovanni had paid only $100,000 and the IRS began to assess penalties for failure to pay the balance. It was not until July of 2009 that Giovanni was able to pay the full amount due. By then, that amount included penalties of over $50,000. She then sought an abatement of the penalties on the basis of reasonable cause. Specifically, she argued that reasonable cause for the late payment existed due to: (1) the death of both of her parents in close proximity in time, making it emotionally difficult for her to handle the tax consequences of settling the estate, including obtaining financing and liquidating assets; (2) the existence of an “unprecedented credit crisis” that impeded the estate's ability to pay the estate tax; and (3) her accountant’s failure to give proper advice about the option of satisfying the estate tax liability through monthly payments. The Court of Federal Claims rejected Giovanni’s arguments, but not because the reasons cited did not constitute reasonable cause per se. Rather, it was because the estate sought and received extensions on three separate occasions. That fact, according to the court, indicates that neither the emotional distress of her situation nor the unfavorable market conditions initially prevented plaintiff from complying with the timing requirements. “With Giovanni’s already having demonstrated through her past actions the ability to meet the required standard of ‘ordinary business care and prudence’. . .  we are unable to conclude that those same, already known circumstances
(whether personal or economic) can later excuse the estate's failure to meet the extended payment deadline.”

Background


Any penalty imposed under the Internal Revenue Code can be abated by the IRS for reasonable cause. Reasonable cause is not comprehensively defined in the Code but has been generally held to mean that, despite the taxpayer’s responsible conduct, either there exist significant mitigating factors or events beyond his or her control caused the failure. Grounds similar to the ones offered by Giovanna have succeeded in other cases. For example, the Internal Revenue Manual itself recognizes that death or serious illness, or a death or serious illness in the taxpayer’s immediate family may constitute reasonable cause for failure to file a return on time or failure to deposit or pay a tax when due. Conversely, an Enrolled Agent study course cautions that emotional distresses related to things such as a divorce and custody battle, childcare responsibilities, and criminal charges have been rejected as reasonable cause. In many of these cases, as in Giovanni’s, the taxpayer’s ability to manage other obligations has defeated the use of illness or emotional distress as a basis for reasonable cause. A repeated pattern of failing to meet deadlines is also detrimental to a claim for reasonable cause. For example, an attorney who failed to file her tax returns on time argued that turmoil in her life as a result of her obligations as a sole practitioner and the illness (Alzheimer's disease and Parkinsonism) and death of her mother constituted reasonable cause. The court pointed out that she was able to conduct her law practice and a horse-breeding activity in spite of her personal difficulties. Further weakening her case was the fact that the failure was not isolated; her pattern of late filing was lengthy and consistent. On the other hand, reasonable cause was found to exist when the taxpayer's children were seriously ill with pneumonia and his wife was incapacitated with an emergency appendectomy. In another case, caring for a sick child and invalid parent, as well as job-related separation from her spouse causing marital discord was deemed sufficient reasonable cause. An evaluation is necessary of the factors in each situation. Just because an EA knows about penalty abatement from Enrolled Agent education doesn’t mean it is the right course of action to pursue for every taxpayer. Some courts have accepted financial difficulty as reasonable cause, and others have indicated that ignorance of the law or mere oversight may suffice. Each case is viewed on its own merits, and the particular facts and circumstances present can result in different degrees of success for taxpayers that appear to be similarly situated. While reliance on tax professionals is often a basis for reasonable cause, executors of estates are subject to a higher standard of vigilance with respect to filing and payment deadlines. In United States v. Boyle, 469 U.S. 241 (1985), an executor retained an attorney to prepare and file an estate tax return. Although the executor periodically contacted the attorney to monitor the attorney’s progress and was assured that he would be notified when the return was due, the return was ultimately filed three months late as a result of the attorney's error. The executor contended that a late filing penalty was unjustified because reliance on the attorney constituted reasonable cause. The Supreme Court rejected this argument, stating “it requires no special training or effort on the executor’s part to ascertain a deadline and ensure that it is met.” The court founded its conclusion on the notion that Congress has “charged the executor with an unambiguous, precisely defined duty to file the return within nine months” and has “placed the burden of prompt filing on the executor, not on some agent or employee of the executor.” Hence, estate executors relying upon professional assistance are still
responsible for assuring that tax practitioners meet deadlines. Finding a CPA specializing in tax matters or conducting an Enrolled Agent search are superior options.

Bill Gates: Windows 8 is 'very exciting'

Microsoft founder Bill Gates on Thursday called the new Windows 8 operating system scheduled for release next month "a very exciting new product" and "a very big deal" for the world's largest software maker.?

Gates said in an interview with The Associated Press that he is already using Windows 8 "and I'm very pleased with it."?

Windows 8 is Microsoft's biggest overhaul of Windows in more than a decade and the company's attempt to stay relevant and exciting in a world where mobile gadgets have started to overshadow personal computers.?

"Hardware partners are doing great things to take advantage of the features," Gates added. "It'll be a big deal."

Microsoft Corp. will release Windows 8 on Oct. 26 along with a new version of Internet Explorer.?

Gates responded to a question about Windows 8 during an AP interview about the Bill and Melinda Gates Foundation's key role in a new global campaign to eradicate polio.

Windows 8 will replace Windows 7 on practically all personal computers sold to consumers.

It features major changes in the way consumers interact with their machines, and versions of it will also run on tablet computers and smartphones.

Although Microsoft has grown into much more than a maker of computer operating systems ? providing computer services to corporations and Xbox gaming machines to game enthusiasts ? Windows still accounts for a significant chunk of the company's annual revenue.

In 2011, Microsoft's "Windows & Windows Live" division generated 27 percent, or $19 billion, of the company's $69.9 billion in annual revenue.?

Samsung Galaxy Music Revealed: Meant for Music Lovers

The rumor mill is in full effect today, after Samsung's recent listing of devices set to receive an upgrade to Android 4.1 (Jelly Bean) divulged a new smartphone: the Galaxy Music. While little was known about the handset at the time of the slip, the Internet has been a frenzy lately with leaked details of the phone.

Samsung Galaxy MusicThe music-centric smartphone will apparently be an entry-level device, as Samsung opts for superior music technology rather than impressive specs. Rumored to house an 850MHz processor and 512MB of RAM, this upcoming smartphone from Sammy falls flat when compared to its other notable gadgets, like the?Galaxy S III?and?Galaxy Note 2. The real kicker for this phone comes in the form of two stereo external speakers, which were shown in action in a leaked image of the device.

The smartphone will reportedly sport a 3-inch QVGA (320 x 480) display, and will pack a measly 4GB of internal storage, though Samsung will offer users the option of more space via the phone's microSD slot. Thanks to the origin of the Galaxy Music's leak, the device can be expected to receive a tasty upgrade to Jelly Bean, though it will ship with Android 4.0 (Ice Cream Sandwich) under the hood.

In addition to a 3-megapixel rear-facing camera, the handset will allegedly feature a dedicated key to open the music player, FM Radio with built-in FM Antenna, Samsung's SoundAlive technology and SRS, while reports also claim that Samsung will integrate its Music Hub service in the device.

A second version of the smartphone is also rumored to be bouncing about. Known as the Galaxy Music DUOS, the phone will feature similar specs to its brethren, with the add-on of dual-SIM support, which means this device isn't likely to hit the U.S. Yet, we will find out soon enough, as Samsung is expected to announce the duo at a press event in Frankfurt on October 11.

Toro Rosso driver Jean-Eric Vergne has said that he is not feeling angry with Michael Schumacher of Mercedes who caused his retirement in the 2012 Singapore Grand Prix after hitting him from behind.

In addition, he said that he was trying to catch up Sergio Perez of Sauber in the previous race when the most celebrated driver in the history of the sport hit him at the rear. Besides, he said that he wasn?t aware of what happened actually during the race.

?I was focussing on catching (Sergio) Perez at that point, trying to brake late to catch him. So I am not too sure what happened exactly, but I assume Michael braked a bit too late and could not avoid running in to me,? he said.

Furthermore, he said that he is feeling a little bit disappointed as he had the chance to attain some reasonable points but could not avail it.

?It's just a shame it did not end with the points for eighth or maybe even seventh place,? he added.

Last week, I wrote a rant-filled post about an SEO firm filling up their client?s site with crappy blog posts because ?that?s what Google wants.?

It was one of my most popular posts ever.

I started thinking about this from the client?s perspective. The content obviously sucked, so it?s not like the SEO could pass this off as ?quality.? And I couldn?t figure out why the hell the client wouldn?t fire the SEO ? or at least say that they were no longer in charge of sourcing the content.

And then, while I was doing pushups during my morning bootcamp class, it hit me.

Learned helplessless has way too many companies by the balls.

I don?t know how many times I?ve heard?

?We want to write more content, but we?re afraid that we?ll do something wrong.

?We?re not sure if this is the right content, but our SEO company says it?s working ? so it must be OK.

?I don?t have time to measure content effectiveness. I?d rather just pay $20 or so per page. That way, if it sucks, I?m not out a lot of money.

?We want to create more content in-house. But we don?t know what to write about or how to set up a workflow. And who has time to figure it out?

Sound familiar?

I understand. I really do. With the 1,000 other things on your plate, it?s easier to ?set it and forget it? than really dig in to your SEO content plans.

But here?s the thing: ?You are ?leaving money on the table by NOT having a content plan in place. And if your writing doesn?t connect with your reader, it?s not doing you any good.

Unless you want things to stay where they are, you need to take action. Now. Right now. Quit screwing around and get yourself the help you need.

As I mentioned last week, your site doesn?t need more words ? it needs the right words. If you need someone to write a kick-ass sales page ? or research and write a blog post ? that?s going to cost you more money. The good news is that it will also make you more money too. Again, if you find a firm that you love and trust, the additional fee you?ll be charge will be way worth the ROi.

?If you want to create content in house, but you?re not sure what to write about ? hire a consultant.

I?m working with more companies in this capacity. I may not write a word of copy, but I do make content recommendations, set up an editorial calendar, teach the marketing team how to find topics and help measure effectiveness. With a good plan in place, those content marketing initiatives start screaming along.

It?s time for you to take control of your SEO content. You wouldn?t settle for a so-so salesperson. Or a customer service rep who didn?t perform. The same goes for your content.

The moment you stop settling is the moment that you?ll start seeing the results you really want. It will take some work and effort on your part, sure.

But it will be worth it. And you?ll be able to break free of the learned helplessness trap.

The Health Insurance Tax (HIT) on fully-insured premium markets imposed by Obamacare could raise $87 billion over the next ten years and also cost between 125,000 and 249,000 jobs by 2021, according to a study.

?Although the tax is formally structured as a fee on health insurers, recent analysis has determined that virtually all of the tax burden will be passed on to the purchasers of insurance,? says the study by the National Federation for Independent Business Research Foundation.

?The cost of health insurance is still a top ranking if not number one issue that?s probably the most unidentifiable per budget year,??Amanda Austin, director of federal public policy at NFIB, told The Daily Caller News Foundation.

?They just don?t know what it?s going to be at renewal, what new costs are going to be borne out in their premium,? she said. ?And that?s the aggravation year in and year out, that they never seem to go down, they only seem to go up, and this will potentially only aggravate the overall cost factor.?

Small businesses and the self-employed comprise 87 percent of the fully-insured market. The NFIB study estimates the tax will raise the cost of employer-sponsored insurance by 2-3 percent, a cumulative cost of nearly $5,000 per family.

?It just seems to me as a small business owner that tax cuts always have a sunset, like the Bush tax cuts? I?ve never heard of anyone say a tax increase is expiring at the end of the year. They seem like they?re built in forever,? small business owner John Culler shared with The DC News Foundation.

Culler owns a small marketing and communications firm in West Virginia with 11 employees. Culler explained that he spends an average of $13,000 a year for family coverage for each employee. He said providing health insurance is both a good recruitment tool and the right thing to do.

?We?ve always felt it was the right thing to do,? he said, though now, ?It just keeps getting harder and harder.?

A coalition of small business advocates and interest groups have joined forces to get the tax repealed. Recently, there has been movement on Capitol Hill with a bipartisan bill with over 220 cosponsors in Congress.

?We want action next year, if not lame duck,? Austin told TheDC News Foundation.

?Business owners understand what this tax is and understand that it?s going to impact their premium and therefore they want their voice to be heard on it.?

?It was a bit of an irritation for us that small business and individuals, which are the main purchasers of fully insured plans, which is where the industry bares the risk, they?re absorbing most of it,? Austin said, recalling when the tax was being considered for the bill that would ultimately become the Patient Protection and Affordable Care Act.

?We were very concerned about this because as an advocate for the business community, we know very well pass-through taxes and how these things are easily borne out to the end user,? Austin added.

She said about the result, ?this is a tax on business? how exactly did we arrive at this when we were trying to lower the cost for small business??

WASHINGTON (AP) ? President Barack Obama is pitching a broad economic argument to voters ahead of next week's debate with Republican opponent Mitt Romney, buying TV time in seven battleground states to promote what he calls a "new economic patriotism."

In a two-minute ad, Obama looks into the camera as he promotes an economic plan he says will create 1 million manufacturing jobs, cut oil imports and hire thousands of new teachers.

The ad set to air in New Hampshire, Virginia, Florida, Ohio, Iowa, Nevada and Colorado comes as Obama and Republican Mitt Romney shadow each other while looking for votes in a closely contested race. On Thursday, the two candidates are scheduled to campaign in the same state for the third straight day, this time in Virginia, a critical battleground in the Nov. 6 election.

Romney is to appear in suburban Washington for a veterans event, while Obama speaks to a farm bureau in Virginia Beach.

The simultaneous visits follow an all-day duel Wednesday in Ohio, where Romney declared he can do more than Obama to improve the lives of average people. Obama scoffed that a challenger who calls half the nation "victims" was unlikely to be of much help.

Meanwhile, new Republican-leaning independent groups have entered the presidential advertising fray as polling suggests Romney's campaign may be losing ground against Obama in key states such as Ohio and Florida.

The commercials, aimed at voters who supported Obama in 2008 but are now undecided, join those from the campaigns and outside groups swamping a narrow and possibly shrinking map of competitive states in the fast-moving presidential contest. Americans for Job Security launched an $8.7 million ad buy in six battleground states, while the Ending Spending Action Fund, a new conservative group bankrolled by billionaire Joe Ricketts, was set to debut a $10 million, four-state ad campaign on Thursday.

Polls show Obama widening his lead in several key states amid backlash from a leaked video in which Romney disparages the 47 percent of Americans who don't pay federal income tax as government-dependent Obama supporters who see themselves as victims and won't take responsibility for their own lives.

Obama's campaign was reveling in the latest public polling but trying to crush any sense of overconfidence. "If we need to pass out horse blinders to all of our staff, we will do that," campaign spokeswoman Jen Psaki said Wednesday.

Romney went after working-class voters at three stops in Ohio, while Obama rallied college crowds at Bowling Green and Kent State. Early voting in Ohio begins next week.

"If President Obama were to be re-elected, what you'd see is four more years like the last four years, and we can't afford another four more years like the last four years," Romney told a boisterous crowd in Toledo at the day's final stop.

Romney said the country had lost more than half a million manufacturing jobs in the past four years. "This is not the path we want for America," he said.

Romney's campaign has been reeling from his caught-on-video comments at a Florida fundraiser last May. New opinion polls, conducted after the video became public last week, show Obama opening up apparent leads over Romney in battleground states, including Ohio and Virginia.

Romney told ABC News that the race was in a statistical tie in some national polls.

"I'm very pleased with some polls, less so with other polls, but frankly at this early stage, polls go up, polls go down," he said.

Obama was not about to let the video comments fade away. He said Wednesday that "America is not about what can be done for us. It's about what can be done by us together, as one nation, as one people."

He added, "You can't make it happen if you write off half the nation before you take office."

'Anarchy' actor dies in fall, is suspect in death

Court records show "Sons of Anarchy" actor Johnny Lewis was released from jail a week before being found dead in his driveway after police say he apparently killed his landlady.

Los Angeles police said Thursday that the 28-year-old Lewis is the only suspect in the death of 81-year-old Catherine Davis, who was discovered slain inside the hillside home in Los Feliz.

Authorities say they are investigating Davis' death and that it appears she was beaten. They say the actor died Wednesday after climbing atop the home and either jumping or falling to the ground.

Actor Johnny Lewis was found dead at this Los Angeles house after apparently falling from the roof of the building he lived in. He is also a suspect in the death of a woman who is thought to have been his landlord and was found dead inside the house.

Lewis pleaded no contest to assault with a deadly weapon and attempted burglary in separate cases this year, according to records.

He enrolled in a drug, alcohol and psychiatric treatment program over the summer, the records show.

Lewis was released from county jail Sept. 21.

As a condition of his probation in both cases, he was ordered not to use narcotics.

Lewis' attorney Jonathan Mandel said Thursday he was "surprised" and "baffled" by the deaths.

Mandel declined to immediately comment on Lewis's criminal history or possible drug problems pending consideration of client confidentiality requirements.?

Before Lewis was discovered Wednesday morning, neighbors reported hearing a woman screaming in the home, said Los Angeles Police Cmdr. Andrew Smith.

Neighbors also told authorities that a man had jumped a fence, assaulted a painter and homeowner next door and jumped back.

It's unclear whether drugs or alcohol were involved, but police are investigating that possibility based on the circumstances of the crime, Smith said.

Lewis had a career spanning more than a decade, mainly in small roles. He played Ricky in the 2007 movie "AVPR: Aliens vs Predator ? Requiem" and was Dennis 'Chili' Childress for two seasons on TV's "The O.C."

His role in "Sons of Anarchy" came in 2008 and 2009.?

Is equity release a gamble worth taking? | Which? Conversation

More grandparents are using equity release to help their family. Yet, is it really that sensible to release money from your home when it can be such an important safety net?

Stories of young people borrowing from ?the bank of mum and dad? aren?t new. But a report by equity release specialist Key Retirement Solutions has highlighted a new trend: young people borrowing from their grandparents, who have released equity in their homes to do so.

Home sweet home

Equity release is a way of freeing up the money in your home without having to move.

Last year, 23% of retired homeowners who took out an equity release plan said lending to their loved ones was their motivation. And in the first six months of this year that rose to 31%. Total lending also increased from ?385.7m to ?446.2m.

Before the recession, the most common reason retired homeowners gave for using equity release was renovating their property, followed by going on holiday. Although home improvements remain the most popular reason (58%), now more homeowners are citing grandchildren?s university fees or helping their children get on the housing ladder.

Does equity release add up?

For many UK retirees, their home is their largest asset ? so making practical use of it makes good financial sense. But it?s worth ensuring that your own financial future is secure before lending a slice of it to your family.

Even those who feel they have a comfortable pension may still find themselves needing to pay for care bills in later life ? which can run to ?50k a year and beyond.

For those who regard their home as a financial backstop, it may make better financial sense to gift it on to their children once they die, rather than removing the safety net before knowing whether they?ll need it.

Given the high charges, high interest rates and inflexible nature of most of the products on the market, equity release is best kept as a last resort. Is it one you?d take advantage of?

Which YouTube Network Should You Sign With?

Recently, I?ve been a getting a good amount of calls from my YouTube friends asking for my opinion regarding which network they should sign with. We?ve written about the 5 things you should know before signing to a YouTube network in the past, but I wanted to write an updated post going more in depth for those who are on the fence about exactly which one they should choose. While I don?t have any direct experience working with specific networks, I can definitely give you guys some good tips based on what I?ve seen other creators have to deal with. So without further ado, here are my personal 5 tips when choosing which specific network to sign with.

5 1 Which YouTube Network Should You Sign With?

1. Take the bad press you hear from others with a grain of salt

A few networks have been publicly called out in the past on issues involving contracts, management, marketing, etc. While I believe that you should do proper research so that you don?t get screwed over after signing, keep in mind that this is a business ? a competitive business where networks are fighting over the best talents available. No matter what people tell you, both parties are out to get the best deal possible. That doesn?t mean that they?re necessarily shady ? its just business in the end. With that being said, if a network really fits with what you want to do, make sure you do your due diligence in protecting yourself legally (see the next point for details).

2. HIRE A LAWYER

I don?t care how expensive they are ? find a good lawyer that you trust and who will sit down with you to discuss your goals. Then have him carefully review/revise the contracts that are presented to you from the networks. If money is a huge issue, one trick I?ve used in the past to get free legal advice is to call up the lawyer and offer to take him out to lunch in exchange for a short consultation when you guys meet. I?ve saved myself a TON of business disasters in the past getting advice from lawyers. Remember: this is your business career we are talking about, so this is an investment you shouldn?t skip out on.

3. Research your audience

While having a great contract and percentage split is great, one of the most important things to take into consideration is whether a YouTube network?s target demographic aligns with yours. You can have the best deal possible, but signing to a network with a different audience than the one you cater to is like putting a History Channel segment about the life of Carl Sagan on Cartoon Network ? no one that visits that network is really going to watch it. How do you research your audience, you ask? Well, by using just a few tools at your disposal you can get a rough estimate:

  • Step 1: Go to your YouTube ?Analytics? tab and click ?Demographics? on the left sidebar.
  • Step 2: Go to Quantcast.com
  • Step 2: Type in the main website of the potential network you want to sign with, then scroll down for demographic data.
  • Step 3: Compare how closely your audiences align with each other. The closer it is, the more the network can potentially be a good fit for you. While Quantcast days is not entirely accurate, it gives you some valuable data to help you with your decision.

An even better alternative is that you can simply ask the network for data on their audience and compare that way as well.

4. Figure out what your goals are, and see if they align with the potential network

You really need to sit down and map out what you want to do for your career as a YouTube creator in the long term. Do you want to just stick with YouTube, grow your audience and monetize? Or are you trying to get work outside of YouTube? These things come into play when it comes to signing with a specific network. After you map out a long-term plan, ask for the same from your potential network to see if their plans for you align with your plans for yourself. Some networks focus a lot on aiding the creator on the production end of things, while others may focus more on getting their talents work offline, and yet others focus on building subscribers and monetizing their channels. While some may claim that they can do everything, I personally believe that the truth is that no one can really succeed by spreading themselves too thin, so spend time to really figure out which areas potential networks specialize in to see if they fit with what you need.

5. Meet with employees of the company and see if you vibe well with each other

In the entertainment industry, I believe that it?s very important that you work with people that bring good vibes and help raise your creative juices. That starts with doing your best to align yourself with people who you trust and are comfortable working with. As a good friend in the industry always tell me, ?It?s not about the company you work with, it?s the people?.

Tips for Cooking with Cast Iron and a New Autumn Recipe ? Gluten ...

Do you use cast iron cookware?

I absolutely love mine, especially when autumn rolls around.

My 8- and 10-inch iron skillets are used several times each week during the cooler months of the year. Perhaps that?s because the heartier dishes and seasonal ingredients of fall lend themselves to skillet cookery.

Speaking of seasonal foods, dust off your iron skillet because I have a delightful recipe you will love!

I?ve created a gluten free version of a delicious old fashioned favorite.

Growing up, I enjoyed this sticky sweet cake (or some variation of it with in-season fruits) warm with a scoop of vanilla ice cream as a weeknight dessert. (I know, it looks too impressive for a busy weeknight, doesn?t it?!)

Each year when apples begin to come into season and there?s a nip in the air, I think about this cake. After going gluten free five years ago, that first autumn was bittersweet.

The sweet part was my health almost immediately improved, nothing short of a miracle after 25 years of chronic pain and other autoimmune misdiagnoses and issues.

The bitter part was missing treats like this cake, especially during the holidays and at family gatherings. I felt left out and deprived at times.

Of course, that?s all changed for me. It can change for you, too!

If you?re feeling left out when it comes to your favorite foods, or if you?re already dreading the upcoming holidays, not to worry, Honey Bunch! I have lots of experience and information to share about how to make the most of your gluten free holidays without ever feeling deprived.

Let?s start with this outstanding gluten free version of my Iron Skillet Caramel Apple Cake.

Before we get to the recipe, though, let me share this useful information about cooking with and caring for cast iron cookware.

Cooking with Cast Iron Cookware

Cast iron cookware?

  • Is considered the original non-stick cookware.
  • Is an excellent conductor of heat.
  • Allows us to use less fat when cooking.
  • Is used in a wide range of cuisine.
  • Is extremely versatile, going from stovetop to oven, it can be used for making pancakes, frying chicken, making a stir-fry and even for making cake!

Of course, there are some issues that can arise. Cast iron can?

  • Rust
  • Pit
  • Cause food to stick
  • React with acidic food

Fortunately, these bothersome issues can be corrected by ?curing? or ?seasoning? your cast iron cookware.

Caring for Cast Iron Cookware

All cast iron cookware must be ?seasoned? or ?cured? before use.

This means coating the cookware inside and out with oil, shortening or lard, then baked. (Butter substitutes and cooking sprays are not recommended.)

This process seals the pan, filling small pits and pores in the surface. This is how the slick, non-stick surface of cast iron cookware is developed, and if you?ve used cast iron for cooking, you know that surface only improved with time and use.

Properly seasoning our cast iron cookware also prevents water from entering tiny crevices in the surface and creating rust. It also prevents acidic foods from reacting with the iron.

Seasoning cast iron must be repeated periodically in order to maintain the protective coating. How often you need to season your cookware depends on how much use it gets.

You will know it is time to season your pans again when food begins to stick to them.

Now that you know a bit about cooking in and caring for cast iron, let?s get to that recipe!

Gluten Free Iron Skillet Apple Caramel Cake

Free of gluten/wheat, dairy/casein, corn, peanuts, tree nuts, soy.

Ingredients:

2 large apples, peeled, cored and cut into 1/2-inch-thick wedges
1/4 cup dairy-free room temperature butter substitute (or real butter if you are not dairy-free)
2/3 cup light brown sugar, firmly packed
1 cup all purpose gluten free flour (See ?Notes? below.)
1/3 cup granulated sugar
1/2 cup unsweetened applesauce
1/2 cup milk (dairy- or plant-based will work)
1 egg, lightly beaten
1 teaspoon baking powder
1 teaspoon pure vanilla extract
1/2 teaspoon ground cinnamon
1/4 teaspoon salt

Directions:

1. Preheat oven to 375F and have a potholder handy (the skillet handle may get hot while it?s on the stovetop).

2. Slowly melt 1/4 cup butter substitute (or butter) in an 8-inch iron skillet over low heat.

3. Sprinkle the brown sugar over the melted butter (resist the urge to stir!); arrange apples, rounded side down, on top of sugar and butter in a circular fashion; allow this mixture to cook, uncovered, over low heat while you prepare the batter. (Be sure to keep the heat low and an eye on the skillet so the sugar doesn?t burn.)

4. For the batter, combine remaining ingredients in a mixing bowl and stir until the mixture is smooth.

5. Remove the skillet from the heat and spread the batter carefully over the apples in the skillet so they remain in place (this insures a pretty finished cake).

6. Using that potholder I mentioned earlier, transfer the iron skillet to the preheated oven; bake approximately 50 minutes or until a toothpick inserted into center of cake comes out clean.

7. When the cake is done, remove it from the oven and cool it in the skillet 15 minutes before serving.

8. To serve, carefully run a small spatula or knife around the edge of the cake to loosen. Place a heatproof serving plate over the skillet and carefully invert the skillet (again, using that potholder!) to release the cake onto the serving plate. Cut into wedges, as you would a pie.

Notes:

?For the fat in this recipe, I use a dairy-free butter substitute. Coconut oil can be used, but it will not impart a buttery flavor for the caramel topping like a butter substitute or real butter will.

?I use my own gum-free gluten free flour blend. Either make your own all purpose blend (See my suggestions by entering ?flour blends? in the search box on this page.) or use a prepackaged blend.

?If topping sticks to the skillet when you transfer the cake to the serving plate, simply spoon it back in place on the inverted cake.

?Serve with vanilla ice cream (dairy- or plant-based) or frozen vanilla custard.
