1. As a lawyer, how important is protecting intellectual properties?

Well, it may not be important to all lawyers in all parts of the practice and in all jurisdictions. Many other lawyers practice in such narrow areas of specialty, and/or in such unrelated fields, that intellectual property (I.P.) issues seldom if ever come up for them. Yet for a music and entertainment lawyer like myself, intellectual property protection is an everyday, life-time concern and a regular challenge.

In theory, every business-owner should have a working knowledge of I.P. After all, one's own business name is a property, usually claimable as a trademark or service mark. So, too, might be a band's name or an artist's name.

Clearly anyone in the field of entertainment needs to have a working knowledge of intellectual property - and with respect to their own original material, they need to be vigilant in regards to protecting it. The primary areas that need to be mastered in these respects, are the I.P. areas of copyright and trademark. A good starting-point is the U.S. Copyright Office (USCO) website, to the extent an artist may not already be familiar with it. I first learned about copyright by writing to the USCO and requesting their written materials by mail. This was in the days before the Internet happened.

2. What is it like working with TV actors and musicians?

I love doing it, but for me it is business as usual. My father is an actor who started his career as a child actor in the 1940's. I grew up on tour with my Dad and my Mom while one or both of them were working on summer-stock or other performances.

I played guitar in a rock-and-roll band in high school with a piano-player named John ("Jojo") Hermann, who then became Widespread Panic's keyboard player. I played guitar in a rock-and-roll band in college with Tom Morello, who then became the guitar player for Rage Against The Machine, Audioslave, and Street Sweeper Social Club, not to mention his work as The Nightwatchman. I still play rock music with members of my college band, in what little free time I have these days.

The majority of my friends are in the arts or entertainment in some way. So, it's more than working with actors and musicians. I live with actors and musicians, and in some cases I'm related to them.

3. How does it feel to be the force behind so many forms of media?

I would never say that, because I'm not the talent in the performance or recording. Maybe my clients are, if their work gets heard or seen in any individual case. I think if there is a "force" behind all of it, it's something more akin to divine inspiration - that moment when the creativity runs right through the artist as template or conduit. Artists are original but are also a product of their life experiences, and what they have already seen and heard. The "force" of artistic creativity is a lot bigger than any one of us.

That said, I think an entertainment lawyer has to have a respect of, and also a distance from, the art form. If you lose your objectivity you can't effectively represent someone. The Hippocratic Oath of doctors is something like, "First Rule, Do No Harm". Something like that is also true for an entertainment lawyer. While the first and foremost rule is to protect the client while following the law, one special corollary for entertainment lawyers should be "Don't Impair The Art Form". In other words, don't ever substitute your own notion of artistic judgment, for that of the artist - at least not when you're working, that is. Know that the art is bigger than you.

In this respect, my clients are the force. They teach me what art really is. Every day.

4. Can you tell us a little about your early life and what led up to being an entertainment lawyer?

I grew up in a show business family, as did many other kids I knew in 1960's Manhattan. I grew up in mid-town. I always ran into celebrities, and always recognized them when I saw them - from the newspaper or my old black-and-white television. My neighbors growing up were Walt "Clyde" Frazier, Jack Dempsey, Rusty Staub, Jake LaMotta, Ken Boswell, Jim Fregosi, and Dave Marshall. I played sports at an early age. I played music at an early age. Performances are what people did, and attended, in Manhattan, and still do. I've worked in other areas of commerce, with other forms of businesses, too, but I always considered entertainment the family business - much like a boy who grew up in his father's auto-shop might be more likely to become a mechanic later on, once grown up.

The main question to me was whether I was going to be a performer, as in a baseball player or rock musician - or alternatively, work in the businesses related to those performances. By the time I made that decision, I had already lived through life on the road, and life between casting calls - not to mention with a thrown-out pitching arm and fear of tinnitus. I didn't want to spend an unspecified amount of further time lifting P.A. stacks into and out of unmarked vans, or let the gigs take any more of a physical toll on me. I was thinking long-term. I was reasonably sure that as an entertainment lawyer I could stay as close as I wanted to, to the art forms that meant something to me. I was right.

5. What other lawyers inspire you?

Any lawyer that selflessly works on causes and gives back to the community. I have worked on environmental causes in the past, and that work is the most draining type of pursuit you can ever imagine. It's all-consuming.

My main inspirations are Phil Hoffman, Esq., who was my mentor when I started in the practice of law at Pryor Cashman in New York in 1987 - as well as my entertainment law professor from UCLA School Of Law, Gary Stiffelman, Esq. What they taught me, I take with me and use, every day of my working life.

6. What advice do you have for aspiring musicians?

Well, I wouldn't want my thoughts in an article misconstrued as legal advice for any specific person in any specific situation. That kind of advice should only be sought and obtained in a one-to-one and private dialogue with counsel.

However, I can summarize the things I might say to aspiring musicians who are friends of mine. The main thing now, in 2012, is not to give up. Collectively, we have just turned the corner, in terms of the American economy, and in terms of the music industry specifically.

Many nay-sayers for the past few years doubted whether new artists could ever make money and support themselves on music ever again. Sure, in some respects it is more difficult to do, post-digital downloading. But the music industry has already re-invented itself. The center of gravity is now performance and touring revenue, and merchandise. Don't fight the new model. Embrace the new model.

Furthermore, there is so much more that artists can do now to promote sales and make themselves known, including social media. And the trend is towards eliminating the middlemen who used to introject themselves into every income-stream. Embrace the new model. Make it your own.

I used to have music friends who were afraid to use cell phones. Now, those same friends are managing their publishing businesses with secure lap-tops while on tour. The main bit of advice to music friends always is, "Empower yourself, control your own destiny, and make sure that you (or your counsel) generate all your own documents". I tend to see artists as in either of one or two groups - "Victims", and "Empowered". The fundamental distinction between the two groups, is that the "Victims" make themselves beholden to other people's documents, whereas the "Empowered" control the drafting of their own documents. With the availability of desktop-publishing since the 1980's, there is no excuse in 2012 for not controlling the drafting of the documents that affect your life or your career. There is no reason to ever blindly sign on to someone else's form. All that does is make more work for the litigators.

7. What is your opinion on the current state of the music industry?

I'm sanguine about it.

The best new feature is the ability of artists to self-distribute, either by sale of CD's on tour at retail, or over the Internet.

The worst new feature also relates to the Internet, though, too - the ability of pirates to poach material digitally, in a matter of milliseconds.

Personally, I am happy that a premium is now placed on artists doing live performances, and more of them. To me, that is what the art form is really about, anyway. There are bands re-grouping after 20 or 25 years of inactivity, and going back out on the road. In a way, it's a shame that current economic realities force them back out on the road when they earlier thought they could comfortably retire on royalties. But the fact of the matter is, it's a good thing that one or two whole new generations of music fans now have an opportunity to see and hear these bands and artists. After all, once these bands and artists are gone, all that may remain are the recordings - and the recordings just aren't the same thing as a live performance, or the meet-and-greet afterwards.

8. What's the hardest part of being involved in the entertainment industry?

Knowing that some talent remains undiscovered... and, these days, seeing a trend towards the replacement of union talent with non-union talent, which is a somewhat-related issue. The just-world-hypothesis tells us that talent and hard work should be rewarded. It often is. But it is not always rewarded. Unfortunately politics and luck sometimes play a part in the reward outcome, too.

That said, the trend towards artist self-distribution might be the panacea. The market, the public, should decide which art they want to pay to hear, see, and experience. The decision should not be force-fed to the public by the same 3 or 5 corporate conglomerates.

So I think generally, the hardest part about being involved in the entertainment industry, is knowing that the continued concentration of economic power therein, in the hands of a few rather than many, prevents a lot of good material from being heard or seen.

My hope is that this changes in my lifetime, and that I get to see it. I am going to continue to fight to make the change happen, too.

OnStar's Family Link tracking package launching in mid-April (updated: hands-on)

Looks like OnStar's finally ready to go live with the Family Link program it was talking up last summer. The service, which lets family members track vehicles for the low, low price of $3.99 (on top of an existing OnStar package), is set to begin a phased rollout next month. Family Link revolves around two primary, similarly named features: Vehicle Locate and Vehicle Location Alert. The first lets concerned relatives view the vehicle's location on a map and the second sends an alert at a chosen interval, letting the vehicle's location be known via text or email. The initial roll out will be open to select subscribers in April, with more invitations hitting in June and a more complete rollout later in the year.

We went hands-on with the service at an OnStar demo in New York City, tracking vehicles in both New Jersey and Detroit. Family Link was able to locate a connected truck in Detroit in a mere five seconds, zeroing in on the vehicle's precise location at OnStar HQ in Michigan (note: we had tracked another vehicle in New Jersey a few minutes before -- that time with a roughly 20 second delay). It's not designed for constant tracking -- you won't see the car icon moving down the map as you drive -- but it appears to be an excellent solution for keeping tabs on your kids as they drive OnStar-equipped vehicles. We also took a look at those handy text vehicle location alerts, that OnStar will push directly to any mobile device or email address at user-selected intervals. 'Twist-O' toy inspires collapsible 'buckliball'

The Twist-O, a quirky expandable spherical toy, has inspired a team of engineers to design a 3-D structure that collapses in on itself. The breakthrough, they say, isn't just about fun and games: It could lead to new structures such as buildings with collapsible walls, high-tech drugs, and advanced robotics.

The new structure is a called a "buckliball" in a nod to buckyballs, the spherical all-carbon molecules whose name was inspired by the geodesic domes created by the architect-inventor Buckminster Fuller, according to the team from the Massachusetts Institute of Technology and Harvard University.

The buckliball is a hollow spherical object made of soft rubber and contains no moving parts. Instead, it has 24 carefully spaced dimples. When the air is sucked out of the buckliball with a syringe, thin ligaments forming columns between lateral dimples collapse.

As the thin ligaments buckle, thicker ligaments that form rows between the dimples undergo a series of movements the researchers refer to as a "cooperative buckling cascade."?

MIT explains in a news release: "Some of the ligaments rotate clockwise, others counterclockwise ? but all move simultaneously and harmoniously, turning the original circular dimples into vertical and horizontal ellipses in alternating patterns before closing them entirely."?

This is likely a case where a picture and video are worth much more than words. The collapsed buckliball is in the upper right of this post. Watch the video clip above to see the toy and the ball in action.

The buckliball is the first morphable structure to incorporate buckling as something to be desired, according to MIT. Potential uses include a building with a collapsible roof or wall ? perhaps something more high-tech than the retractable roof at Safeco Field?where the Seattle Mariners play baseball.

Another potential use for such buckling structures might be a robotic arm that uses precisely engineered dimples at hinging points (joints) that bend when activated by a pressure signal.

Orbital junk misses space station after alert

Russian spacecraft stick up from their docking ports on the International Space Station during Saturday's encounter with a piece of space junk. Spacefliers took shelter in their Russian Soyuz lifeboats as a precaution.

The International Space Station's crew members took shelter in their Russian Soyuz lifeboats as a precaution during Saturday's totally harmless passage of a piece of space debris.

In a series of Twitter updates on Friday night, NASA said a hunk of junk from a Russian satellite was projected to fly past the space station at an estimated distance of 14.8 kilometers (9 miles), at around 2:38 a.m. ET Saturday. That was within the zone that required precautionary measures to be taken. The zone is called a "pizza box" because of its shape: 50 kilometers (30 miles) on a side, and 750 meters (a half-mile) above and below the plane of the station.

The appointed time came and went without incident. "Nichevo ... Nothing," one of the Russian cosmonauts said. The spacefliers had hoped to catch a glimpse of the object, but no visual sighting was reported.

NASA said the relatively small piece of debris was a leftover from the 2009 collision involving an Iridium telecommunications satellite and Russia's Cosmos 2251 military communications satellite. It was detected by radar on Friday, sparking the alert.

"Everything went by the book," NASA spokesman Rob Navias said after the all-clear was sounded. He said the station's controllers followed a "precautionary and conservative" approach by ordering the crew to take shelter.


The station currently has six crew members aboard: two Americans (Don Pettit and Dan Burbank), three Russians (Anton Shkaplerov, Anatoly Ivanishin and Oleg Kononenko) and Dutch astronaut Andre Kuipers. The spacefliers were awakened a little more than an hour earlier than scheduled and put the station's control systems into standby mode. Then they took their places in the two Soyuz craft docked to the station and closed the hatches.

The crew members were prepared to descend back down to Earth if the piece of debris had collided with the 450-ton space station and dealt such a serious blow that the orbital outpost had to be abandoned. Instead, they merely reopened the hatches, returned the control systems to their regular settings and resumed a "normal and relaxing weekend," Navias said.

He said it was "serendipitous" that the precautionary measures were taken on the astronauts' day off, meaning that there would be "no impact to scientific research or any other crew work."

Not the first time, or the last
NASA issued a similar collision alert back in November, but called off the alert even before the astronauts' appointed time to get into the Soyuz space capsules. Last June, the crew actually did get into the Soyuz craft due to a collision threat, but the space junk whizzed past at a distance of 850 feet (260 meters). Astronauts took similar precautions in April 2009 and November 2008.

On other occasions, the space station has changed its orbital path slightly to eliminate the risk of collision with space debris. That's how NASA dealt with potential collision threats in January, involving debris from the Iridium satellite as well as from a Chinese satellite that was smashed up in 2007. But in order to use that option, the crew needs more than a day of advance warning.

Experts say there are more than 20,000 pieces of orbiting space junk more than 10 centimeters wide ? that is, bigger than a softball. Lots more pieces are smaller, down to the size of a marble. "More than 500,000 pieces of orbital debris are tracked," NASA noted Friday night.

These bits of debris zip around the planet at speeds of 17,500 mph relative to Earth, and could cause serious damage if they were to hit the space station just wrong. NASA and the Defense Department keep close track of the bigger pieces, but the experts are worried that the space-debris problem will only get worse in the years ahead.

All sorts of schemes have been proposed to address the problem, including the idea of shooting water guns or lasers at pieces of space junk, or throwing nets over them. Update for 11:05 p.m. ET March 23: I originally said the "pizza box" zone was 25 kilometers on each side, but what I meant to say was that it extends 25 kilometers out from the space station on each side. That means the total dimension of the box is 50 by 50 by 1.5 kilometers, with the station in the center, as NASA explains.

Update for 12:55 a.m. ET March 24: When the space station crew was awakened this morning, Mission Control told NASA astronaut Dan Burbank that the debris was projected to come within 9 miles, which is closer than the initial estimate of 14.3 miles. I updated the figures to reflect that, but even the updated estimates had a measure of uncertainty. That's why the spacefliers took shelter.

Excitement Builds for 1st Private Spaceship Flight to Space Station

Anticipation and excitement over the first-ever launch of a private spaceship to the International Space Station next month is steadily building, astronauts and NASA flight controllers said Tuesday (March 20).

Private space company SpaceX, based in Hawthorne, Calif., is preparing to launch its Dragon capsule to the space station April 30. The unmanned capsule will be the first of a new fleet of commercial spacecraft being developed to deliver cargo to the station in the wake of the space shuttle retirement last year.

The Dragon capsule will launch atop a SpaceX Falcon 9 rocket from Cape Canaveral Air Force Station in Florida. If all goes well, it will fly up to the orbiting laboratory, conduct tests, and then dock there May 3.

"Our fingers are crossed for SpaceX to launch and successfully come to the space station," NASA astronaut Sunita Williams said during a news conference Tuesday. Williams is due to lift off atop a Russian Soyuz spacecraft July 15, along with a Russian cosmonaut and a Japanese astronaut, to serve on the space station's Expedition 32 and Expedition 33 missions.

If SpaceX's April test flight goes smoothly, another Dragon capsule will make the first official cargo delivery run in August, when Williams and her colleagues Yuri Malenchenko of Russia and Akihiko Hoshide of Japan will be aboard the outpost. [Gallery: Dragon, SpaceX's Private Spacecraft]

"We're really excited," said Williams, who will command the space station's Expedition 33 crew. "Aki and I actually went to California about a year ago for some training with SpaceX and had the opportunity to look around at the company and at what they were doing on the floor building the spacecraft. That was pretty awesome and to see a bunch of really excited engineers and scientists working on this spacecraft was great."

Hoshide agreed, saying he supports the development of the commercial space industry.

"Getting the commercial sector involved, I think it's a good thing," he said. "It opens up new doors. I'm looking forward to that very much."

Yet on the same day that astronauts lauded the private spaceflight rise, members of Congress expressed concerns over the safety and risk of new commercial vehicles during a hearing before the House Subcommittee on Space and Aeronautics.

And SpaceX isn't the only company joining the new private space effort. In addition to the California company, NASA has awarded a contract to Orbital Sciences of Dulles, Va., under the Commercial Orbital Transportation Services (COTS) program.

Orbital's Cygnus vehicle could make its first launch to the space station on Sept. 1, with a docking Sept. 6, said NASA's space station program director Mike Suffredini.

But first, all eyes will be on SpaceX next month, as it prepares to make a significant step forward in the new partnership between NASA and the private sector. Still, the mission is still a test flight, and Suffredini emphasized that spaceflight is always a risky business.

"You want every flight to work exactly as you planned it, but we had initially planned on two demo flights, so if something happens during this flight regardless of what that is, we will learn, SpaceX will learn," Suffredini said. "We need to be careful not to assume that the success or failure of commercial spaceflight is going to hang in the balance of a single SpaceX flight."

And SpaceX isn't content to use Dragon for delivering only food and supplies. The company hopes to eventually upgrade its capsule and rocket system to carry people to orbit, including NASA crews to the space station.

More Evidence Shows That Daily Aspirin Might Combat Cancer

TUESDAY, March 20 (HealthDay News) -- Aspirin, a popular weapon in the war against heart attacks, may also play a role in cancer prevention and treatment, three new British studies suggest.

"We have now found that after taking aspirin for three or four years there starts to be a reduction in the number of people with the spread of cancers, so it seems as well as preventing the long-term development of cancers, there is good evidence now that it is preventing the spread of cancers," said lead researcher Dr. Peter M. Rothwell, a professor of neurology at the University of Oxford and John Radcliffe Hospital in Oxford.

"Because aspirin prevents the spread of cancers, it could potentially be used as a treatment," he added.

But the research is not conclusive, and did not prove that aspirin combats cancer. So, people should not start popping aspirin in the hopes of thwarting cancer, experts said.

Previously, these investigators showed that a daily dose of aspirin taken over 10 years appeared to prevent some cancers, but the short-term benefits and the benefits for women weren't clear.

Currently, a daily low-dose aspirin is recommended for people who have had a heart attack or stroke to prevent another. "It may well be that taking aspirin to prevent cancer becomes the main reason for taking it," Rothwell said.

Aspirin may work against cancer by inhibiting platelets, which promote clotting and also help cancer cells spread, he said.

The papers were published March 21 in The Lancet and The Lancet Oncology.

In one study, Rothwell's team analyzed data from 51 clinical trials comparing aspirin with no aspirin in preventing heart attacks.

Overall, daily low-dose aspirin reduced the risk of dying from cancer 15 percent. Taking aspirin five years or more reduced the risk 37 percent, and over three years, the risk reduction was about 25 percent for both men and women, the researchers noted.

In addition, aspirin was associated with a 12 percent reduction in deaths from non-cardiovascular causes, they found.

In another study, Rothwell's team looked at the effect of aspirin on slowing the spread of cancer, or metastasis.

Their data came from five clinical trials that also looked at daily low-dose aspirin (75 milligrams or more) and heart attack and stroke prevention. The researchers zeroed in on patients who developed cancer.

Over more than six years of follow-up, low-dose aspirin reduced the risk of distant metastasis by 36 percent, compared with cancer patients receiving a placebo, they found.

Moreover, aspirin reduced the risk of metastasis in solid tumors, such as colon, lung and prostate cancer, by 46 percent and by 18 percent for cancers of the bladder and kidney.

It also reduced the risk of diagnosing a cancer that had already spread by 31 percent. For those who continued to take aspirin after a cancer diagnosis, the risk of metastasis was cut by 69 percent, the researchers calculated.

Aspirin also reduced the risk of dying from cancer by about half. These risk reductions remained after taking into account age and sex, the researchers said.

In a third study, Rothwell's group looked at the effect of aspirin on metastases by analyzing observational studies rather than clinical trials.

These studies revealed a 38 percent reduction in colon cancer, which matched well with the risk reduction seen in clinical trials, they said. There were similar findings for esophageal, gastric, biliary and breast cancer, they added.

While the study is attention-getting, not everyone agrees with the overall conclusions.

Among them is Nancy R. Cook, an associate biostatistician at Brigham and Women's Hospital and Harvard Medical School in Boston and co-author of an accompanying journal editorial. She pointed out that these studies only dealt with trials where aspirin was given daily, whereas two large trials in which aspirin was given every other day found no connection with cancer prevention.

"Aspirin seems to work for people who have had cardiovascular disease. Perhaps in the long-term it will turn out to be protective for cancer, but we need to verify that and get more information," Cook said.

And, aspirin is not benign, Cook said, pointing out risks for bleeding and other gastrointestinal problems.

People should not start taking aspirin hoping to preventing cancer, Cook said. "Most of the studies show that the effect doesn't accrue until after 10 years," she noted.

Eric Jacobs, strategic director of pharmacoepidemiology for the American Cancer Society, said that "this study provides important new evidence that long-term daily aspirin, even at low doses, may lower risk of developing cancer."

However, any decision about treatment should be made on an individual basis in consultation with a doctor, he said.

"Because these results are new," Jacobs added, "it will take time for the broader scientific community to evaluate the data in the context of existing knowledge and to consider whether the clinical guidelines should be changed."
